When Justice Knocks on the Door: The Case of Federico Pignatelli and the Power of Reivindication

Have you ever wondered what to do when someone takes something that legally belongs to you? When your apartment, commercial premises or any other property is simply taken away from you, without your consent, without explanation, without right? In such moments a crucial legal mechanism comes to the fore: reivindication.

Reivindication is a lawsuit by which an owner demands the return of their property if someone else possesses it unlawfully. It is a classic legal tool that has its roots in Roman law. In modern practice it primarily means protection of the constitutionally guaranteed right of ownership. Distinguished lawyers emphasize that reivindication represents a tool against arbitrary dispossessions and is a cornerstone of legal security for every individual.

The story of Federico Pignatelli, heir of the Mayer family, is one of the most harrowing cases in modern Slovenian legal history. The Mayer family lost their property on Wolfovi ulici 1 in Ljubljana after World War II. After Slovenia's independence and the family's successful rehabilitation, the building was returned. Federico and Luigi Pignatelli bought out relatives' shares and decided to renovate the building.

In 1993 they established the company Eurocapital for management, in which Federico Pignatelli was the legal representative, and the local procurator was Igor Tomažič. Legal assistance was provided to them by attorney Tjaša Andree Prosenc. In 1998 Federico and Luigi handed written authorizations to the attorney for changes in the court register, with the clear instruction: to delete procurator Tomažič, but not the legal representative Pignatelli.

The attorney did not follow the instructions. She forged the minutes of the company's general meeting in the court register, with the help of notary Miro Košak, and instead of Federico Pignatelli as representative entered his mother, Doris Mayer Pignatelli, under a name that did not even exist in the official documents. Then, with the help of an illegal note, she deleted the legitimate representative from the register and, together with her son, appropriated the apartment and two commercial premises in the prestigious building in the centre of Ljubljana.

After discovering the abuse, Federico filed numerous lawsuits in which he demands the deletion of illegal entries in the register, the return of the property and compensation for the damage suffered. A reivindicatory action would make it possible to return the matter to the lawful owner. The conditions for success are: proof of ownership, proof that the opposing party has no right to possess the property, and proof that the ownership right was unlawfully taken.

The Pignatelli case is not just a story about one man and one piece of property. It is a warning about how even lawyers can abuse trust, and how the only defense is the strength of the legal system, if it functions. In Slovenia, where property is a constitutionally protected right, this is not a matter of opinion but of legal order.
