The act for which the court has already found Tjaša Andree Prosenc guilty

In the previous account of the criminal story connected to the building at Wolfova 1 it was described how lawyer Tjaša Andree Prosenc betrayed her client. First, by falsifying documents she entered an illegitimate company representative into the court register. Then, on the basis of that act, by fraud she "sold" the apartment to herself, and to her son Gregor Prosenc two commercial premises on the ground floor.
Among other abuses, the act for which the "court has already found the notorious lawyer guilty" stands out. In 2009 Tjaša Andree Prosenc, in the role of authorized representative of the company Eurocapital, signed a contract that was harmful to the company.
In the building that was returned to the family after the rehabilitation of Emerik Mayer, tenants with the right to non-profit rent lived. Among them was Dr. Marko Matjašič. After his death his daughter Eva Matjašič demanded the conclusion of a lease under the same conditions, but that right did not belong to her.
Tjaša Andree Prosenc, as an authorized representative of the company Eurocapital, "acted contrary to the interests of her client." In 2009 she signed a lease agreement with Eva Matjašič. The apartment measuring 117.44 m² in the center of Ljubljana was leased for 286.25 EUR per month for life, while the appropriate amount would have been more than twice that according to the court appraiser's estimate.
The lawyer claimed that she did everything with the consent of the owners and that the true owner of the company was Doris Mayer. However, she could not produce any document, which is irresponsible in such transactions.
The court found her guilty. The damages lawsuit procedure has been dragging on since 2013. The court awarded Federico Pignatelli, i.e. the company Eurocapital, damages in the amount of 49,629.08 EUR with default interest.
