Zakaj Federico Pignatelli toži Odvetniško zbornico Slovenije?

The Slovenian Bar Association (OZS) should safeguard professionalism and ethics in legal practice. In developed nations, bar associations maintain their profession's credibility through rigorous member oversight. However, OZS has demonstrated indifference to fundamental procedural principles by denying Federico Pignatelli the opportunity to present arguments before disciplinary and ethics commissions.

In 2022, Pignatelli filed a lawsuit against OZS challenging the legality of an opinion regarding attorney Tjaša Andree Prosenc's conduct and seeking damages for rights violations. The core issue involves written authorization granted in 1999 to Prosenc for executing company decisions in the business register.

According to Pignatelli's account, co-owners Luigi and Federico Pignatelli approved a company transformation, capital contributions, and critically, a resolution stating "direktor družbe ostane Federico Pignatelli" (the company director remains Federico Pignatelli). However, Prosenc allegedly registered a fabricated resolution appointing "Doris Mayer Pignatelli" as director—a name combining Pignatelli's late mother's identity with his surname, creating a legally non-existent person.

This foundational falsification allegedly enabled subsequent fraudulent transactions, including property acquisitions by Prosenc and her son Gregor Prosenc, despite Pignatelli's explicit refusal to sell. The dispute centers on the Court Register's acceptance of improper documentation and the cascading illegality resulting from this initial forged entry.

Pignatelli maintains that OZS violated procedural fairness by concluding proceedings without examining his evidence, ultimately acquitting Prosenc. He asserts all documents derived from the original falsification must be nullified and demands appropriate disciplinary action.
